DOVER - The Pennsylvania man accused of breaking into a Somersworth woman's home, living in her attic and taking pictures and videos of her genitals as she slept took the stand in his own defense on Friday, one time admitting he was "ashamed" of what he did.
It was the third day of a four-day trial to decide if Mauricio Damian Guerrero, 22, of Bensalem, Pa., is guilty of five counts of felony burglary and two misdemeanor counts of invasion of privacy.
Guerrero testified for about an hour and a half, often wiping his eyes, often appearing confused and often expressing remorse about what he had done during the 48 hours between Feb. 7 and early Feb. 9 when he was arrested by Somersworth Police who spotted him on the roof of her house trying to flee.
Under questioning from defense attorney Harry Starbranch Jr., Guerrero told the court in his mind he thought he and the victim had a relationship, a relationship in which she "thought it was hot" that he was stalking her.
Guerrero said he first met the victim when he subscribed to her OnlyFans page, a website that allows hosting services mostly for sex workers, who appear in various stages of undress on a pay-for-view basis.
The two quickly took to texting back and forth on the website but soon switched to texting on their phones. The victim gave him her address so he could send her gifts and money to her previous residence in Dover.
Over the course of their several-months relationship, they ended up exchanging thousands of texts, however, they only met in person three times: once when they met briefly at her Dover apartment and he left her cash on her car's dashboard, once shortly before Christmas 2021 when they had sex after which she asked him to leave, and shortly before midnight on Feb. 8, 2022, when she met him briefly outside her Highland Street home.
During that encounter she said they talked briefly before he pushed her head down to his genitals and she complied for about five seconds before being "grossed out" and getting angry with him, she testified earlier in the trial.
On the stand Friday, however, Guerrero said she complied for about two minutes before stopping and he was "fine with that" when she stopped.
The victim testified on Thursday that she then told him to never come to her home ever again before going back inside, where she said she drank some wine and went to bed.
Guerrero said he hung around the neighborhood for about an hour in his truck, thinking she was going to call him and tell him to come back, but she never called, he testified.
"After she never called back what did you do?" Starbranch asked.
"I decided to go in," Guerrero said.
"And when you got in the house, what did you do?"
"I wasn't thinking straight that night, I was confused," Guerrero said.
"When you went in the house that night, what were your intentions?" Starbranch continued.
After a long pause, Guerrero answered, "Just to talk to her ... to make her happy. Because this was like a fantasy that she would want me to do."
After being in the house for a while, he went into her bedroom where the victim was sleeping.
"What did you do?" Starbranch asked
"I believed it was just a game of ours that she wanted to do so I decided to take a picture of her vagina," Guerrero said.
Soon after he heard the victim say "Wow" and she gasped loudly.
"I was scared and I left," Guerrero said. "I wanted to leave."
"What did you do then?"
"I went up to the attic," he said. "I wanted to leave."
By now the victim's mother had called police to say there may be a stalker in the house.
When police arrived they spotted him on the roof and took him into custody.
Guerrero faces up to 45 years if convicted on the three most serious burglary charges, in which the sentences are elevated because they were during the nighttime and in one's own domicile.
The trial continues Monday with more direct questioning from Starbranch before cross-examination by the state.
