New law expected to tamp down on companies' mining of customer data

CONCORD - The Data Privacy Unit in the Consumer Protection and Antitrust Bureau began enforcing the New Hampshire Data Privacy Act ("NHDPA" or the "Act") on Jan. 1.

The new law forces businesses covered by the Act to comply with the consumer rights created by the NHDPA, in addition to the other obligations outlined by the Act. These rights and obligations ensure accountability, transparency, and consumer choice by regulating how certain companies may process the personal data of New Hampshire consumers.

To help consumers understand their rights under the NHDPA, and to help covered businesses comply with the obligations created by this act, Attorney General John M. Formella announces the publication of Frequently Asked Questions on the New Hampshire Department of Justice website. These Frequently Asked Questions are located at the following link: https://www.doj.nh.gov/data-privacy-enforcement.

Formella encourages anyone who would like to better understand their rights and obligations under the NHDPA to review both the Frequently Asked Questions page and RSA 507-H.

Assistant Attorney General Warren Cormack and Investigative Paralegal Isaiah Hutchinson have been hired to staff the Data Privacy Unit. Anyone wishing to report a violation of the NHDPA is encouraged to fill out a Consumer Protection complaint form at this link or to email: CPB-DOJ@doj.nh.gov.
