The pair charged in the shooting of a Lebanon man during a botched robbery attempt in his Second Street home in January were both formally indicted this month by a York County grand jury.
Susan Gutierrez, 49, of Epping pleaded not guilty to the charges earlier this month in York County Superior Court, while her accomplice, suspected triggerman Ronald A. Bauer, 48, of 96 Central St., Farmington, N.H., remains confined to a New Hampshire state prison on parole violations related to firearms and drug trafficking convictions in Strafford County.
Bauer was said in the throes of robbing the home on Jan. 8 when he was confronted by the homeowner as he returned for lunch. Bauer is alleged to have shot the man and fled in his SUV.
Gutierrez, who allegedly waited in her BMW convertible at the Dunkin’ Donuts on Route 202 in East Rochester for Bauer to do commit the robbery, met up with her boyfriend at the Big Lots on Milton Road where they made off with some stolen belongings which they later attempted to fence at a Portsmouth pawn shop.
About a week later they were arrested in Somersworth. Bauer was returned to prison, where he could remain as late as November 2014 before being extradited on the Lebanon charges.
Gutierrez is housed at the York County Jail in Alfred on $400,000 bail.
The York County grand jury indictments on Bauer include elevated aggravated assault, burglary, theft and possession of a firearm by a prohibited person; Gutierrez’ include elevated aggravated assault, burglary, theft and hindering apprehension.
The victim is said to be recovering from the gunshot wound, which left him paralyzed with bullet fragments in his spine.
No York County Superior Court dates are set as of today on either defendant.
