CONCORD - An elderly Derry man has been found incompetent to stand trial in the 2019 shooting death of his wife.
The Attorney General's Office made the announcement on Monday regarding alternative charges of reckless and knowing second-degree murder against Roderick Munstis, 80, in the killing of his wife, Ellen Munstis, 74.
Munstis was accused of shooting his wife multiple times in August 2019.
Since his arrest, Munstis underwent a competency evaluation by the Office of the Forensic Examiner, Dr. Shannon Bader, who concluded that he was not competent to stand trial and restorable.
In light of the fact that Munstis was found incompetent to stand trial and not restorable, the law required that the charges be dismissed without prejudice to the state.
On Monday the Rockingham County Superior Court entered such an order and dismissed the murder charges against Munstis.
