CONCORD - The City of Rochester's appeal of the Right to Know Ombudsman's decision that deferred to the legislature or judiciary what "cit8izen" means in the state's Right to Know statute was moved to Strafford Superior Court on Thursday.
The Rochester Voice in August filed the RTK case with the RTK Ombudsman's Office because the City of Rochester in April said it would be ending digital delivery of RTK documents to The Rochester Voice because its editor and publisher, Harrison Thorp, are domiciled in in Maine.
Soon after the decision by Ombudsman Attr. Thomas Kehr, the City of Rochester appealed his decision to Merrimack Superior Court, where Thorp and City of Rochester Attorney Terence O'Rourke attended a hearing presided over by Judge Brian T. Tucker Thursday morning.
O'Rourke and Thorp spoke privately before the hearing and agreed that it was far more practical to move the venue to Strafford Superior Court in Dover.
During the hearing O'Rourke made the motion to change the venue to Strafford Superior Court, and Thorp echoed his support for the move since the Concord court is roughly double the distance of traveling to Dover.
Later on Thursday The Rochester Voice received an e-filed document in which Judge Tucker granted the motion.
The case was continued to an unspecified date.
