City pair among trio charged with riot in New Durham fracas that left man injured

DOVER - Three men including two from Rochester have been indicted on riot charges stemming from an altercation in New Durham last May that left a man injured.
Donovan J. Montrose-Banks, 30, formerly of Milton Road, Rochester, Dustin King, formerly of Portland Street and Dakota Thomas Staples, 21, formerly of Lafayette Road, Portsmouth are accused of riot when they allegedly, "did simultaneously engage in tumultuous or violent conduct ... creating a substantial risk of causing pubic alarm."
The indictment further alleges that King was armed with a wooden board during the May 20 attack.
The victim is said to have sustained physical injury as a result of the incident.
All three men face sentences of three and a half to seven years if convicted.
The February grand jury indictments were handed down on Feb. 18 and released on Wednesday
An indictment is not an indication of guilt, rather that enough evidence has been presented to move forward to trial.
